Terms of Service

These Terms of Service ("Terms") govern your use of the FOLEY mobile application and the aypsound.com website (collectively, the "Service"), operated by AyP Sound LLC ("we", "us", "our"). By using the Service, you agree to these Terms.

1. The Service

FOLEY is a mobile application for recording, categorizing, and sharing real-world sound effects. All sounds contributed through FOLEY are released under the Creative Commons Zero (CC0 1.0 Universal) public domain dedication.

2. Your Account

You must be at least 13 years old to use FOLEY. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information when creating your account and to keep it up to date.

3. Sound Recordings

You represent and warrant that each sound you upload: (a) was recorded by you, (b) does not contain copyrighted music or other protected content, (c) does not contain identifiable private conversations without consent, and (d) was recorded in compliance with applicable laws.

4. FOL Creator Credits

FOL creator credits are digital utility tokens within the FOLEY platform. They are earned by contributing quality recordings and through community activities such as receiving tips from other creators.

FOL credits are not money, cryptocurrency, securities, or any form of financial instrument. They have no monetary value outside the FOLEY platform and cannot be exchanged for cash, traded between users, or transferred off-platform. We reserve the right to modify the FOL credit system at any time.

5. Acceptable Use

You agree not to: upload sounds you did not record or do not have rights to share; use the Service to harass, abuse, or harm others; attempt to manipulate the FOL credit system through automated or fraudulent recordings; reverse engineer, decompile, or otherwise attempt to extract the source code of the Service; or use the Service in violation of any applicable law.

6. Content Moderation

We reserve the right to remove any recording that violates these Terms, contains inappropriate content, or is flagged by our automated quality systems (e.g., duplicate or extremely low-quality recordings). We may suspend or terminate accounts that repeatedly violate these Terms.

7. Intellectual Property

While all user-contributed sounds are CC0, the FOLEY app, brand, design, and underlying technology remain the intellectual property of AyP Sound LLC. You may not use our trademarks, logos, or branding without written permission.

8. Third-Party Services

FOLEY integrates with third-party services for authentication (Apple Sign-In), storage, and processing. Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We make no warranty regarding the quality, accuracy, or completeness of any sound recordings available through the Service.

10. Limitation of Liability

To the maximum extent permitted by law, AyP Sound LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us (if any) in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
